  • It turned out that D had no right to grant the lease since the right to reserved to the trustees of the land
  • C sued D for breach of contract, the trial judge awarded £200 for the loss of benefit the lease would have conferred on him (known as expectation loss)
  • D argued that C could only recover for his expenses
